PLEASE READ THE TERMS AND CONDITIONS OF THIS ONLINE POLICY VERIFICATION SYSTEM USER AGREEMENT ("AGREEMENT") CAREFULLY BEFORE USING THE SYSTEM. BY YOUR USE OF THE SYSTEM, YOU ACKNOWLEDGE AND EVIDENCE YOUR CONSENT TO AND AGREEMENT WITH THE TERMS AND CONDITIONS SET FORTH HEREIN.

This Online Policy Verification System ("System") is provided by Southern Farm Bureau Casualty Insurance Company and Farm Bureau Mutual Insurance Company of Arkansas, Inc. (individually and collectively "Arkansas Farm Bureau Insurance"). This User Agreement may be modified at any time by Arkansas Farm Bureau Insurance. You will be prompted by the System to review and accept the changes or revisions incorporated into the Agreement before continued use of the System will be allowed.

Your failure to follow any of the rules herein, whether listed below or in supplemental notices, will result in termination of your access to the System, without notice, as well as in Arkansas Farm Bureau Insurance seeking any other remedies in its sole and absolute discretion.

1. User ID/Password. You are responsible for maintaining the confidentiality of your USER ID and your Password. You agree to accept responsibility for all activities under your USER ID and Password.

You acknowledge and agree that information to which You are given access is strictly confidential and may not be used for any marketing or other purpose, other than as set forth in paragraph 2(a) above. You agree to comply with § 502(e)(3)(D) of the Gramm-Leach-Bliley Act and the rules and regulations promulgated thereunder, which provides for a general exception from providing notice and an opportunity for opt-out to consumers for disclosures made to persons holding a legal or beneficial interest relating to a consumer.

4. Ownership. The trademarks, logos, and service marks displayed on this site (collectively, the 'Trademarks') are registered and common law trademarks of American Farm Bureau Federation. Nothing contained on this site should be construed as granting, by implication, estoppels, or otherwise, any license or right to use any of the trademarks without the written permission of American Farm Bureau Federation.

This site contains copyrighted and other proprietary information. You may not in any way make commercial or other unauthorized use, by publication, re-transmission, distribution, performance, caching or otherwise, of material obtained through the System, except as permitted by applicable law.

5. Disclaimer of Warranty. ARKANSAS FARM BUREAU INSURANCE MAKES NO WARRANTY OF ANY KIND REGARDING THE SYSTEM, THIS SITE OR ANY CONTENT OR DATA PROVIDED ON THE SITE, ALL OF WHICH ARE PROVIDED ON AN 'AS IS' BASIS. ARKANSAS FARM BUREAU INSURANCE DOES NOT WARRANT THE ACCURACY, COMPLETENESS, CURRENCY OR RELIABILITY OF THE SYSTEM, THIS SITE, OR ANY OF THE CONTENT OR DATA FOUND ON THIS SITE AND EXPRESSLY DISCLAIMS ALL WARRANTIES AND CONDITIONS, INCLUDING IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, AND THOSE ARISING BY STATUTE OR OTHERWISE IN LAW OR FROM A COURSE OF DEALING OR USAGE OF TRADE. ARKANSAS FARM BUREAU INSURANCE DISCLAIMS ANY WARRANTY OR REPRESENTATION THAT THIS SITE, ITS SERVERS OR ANY E-MAIL SENT FROM ARKANSAS FARM BUREAU INSURANCE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. SOME STATES DO NOT ALLOW THE DISCLAIMER OF IMPLIED WARRANTIES, SO THE FOREGOING DISCLAIMER MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC RIGHTS WHICH VARY FROM STATE TO STATE.

6. Limitation of Liability. ARKANSAS FARM BUREAU INSURANCE ASSUMES NO RESPONSIBILITY, AND SHALL NOT BE LIABLE FOR, ANY DAMAGES TO, OR VIRUSES THAT MAY INFECT, YOUR COMPUTER OR OTHER PROPERTY ON ACCOUNT OF ACCESS TO OR USE OF THIS SITE OR YOUR DOWNLOADING OF ANY MATERIALS OR DATA FROM THIS SITE. IN NO EVENT SHALL ARKANSAS FARM BUREAU INSURANCE BE LIABLE FOR ANY INJURY, LOSS, CLAIM, DAMAGE, OR ANY SPECIAL, EXEMPLARY, PUNITIVE, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND (INCLUDING, BUT NOT LIMITED TO LOST PROFITS, WHICH ARISES OUT OF OR IS IN ANY WAY CONNECTED WITH (1) ANY USE OF THIS SITE OR CONTENT FOUND HEREIN, (2) ANY FAILURE OR DELAY (INCLUDING, BUT NOT LIMITED TO THE USE OF OR INABILITY TO USE ANY COMPONENT OF THIS SITE), OR (3) THE PERFORMANCE OR NON-PERFORMANCE BY ARKANSAS FARM BUREAU INSURANCE, EVEN IF ARKANSAS FARM BUREAU INSURANCE HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES.

7. Jurisdiction/Enforceability. You agree that this Agreement and its performance, for all purposes, shall be governed and construed in accordance with the laws of the State of Arkansas without regard to its conflict of laws provisions. You consent and submit to the exclusive jurisdiction of the state and courts located in Pulaski County, Arkansas, in all questions and controversies arising out of your use of this site and/or this Agreement.

Should any provision of this Agreement be held invalid, unlawful or for any reason unenforceable, then the invalid, unlawful, or unenforceable provision shall be severable from the remaining provisions. Such invalid, unlawful, or unenforceable provision shall not affect the validity or enforceability of the remaining provisions.

8. Entire Agreement. This Agreement is the complete and entire agreement between the parties and supersedes any prior understandings or agreements, whether written or oral, regarding this subject matter.

9. Indemnification. You agree to defend and indemnify Southern Farm Bureau Casualty Insurance Company and Farm Bureau Mutual Insurance Company of Arkansas, Inc., as well as their respective affiliates, officers, directors, employees, and agents from and against any claim, cause of action or demand, including without limitation reasonable legal and accounting fees, brought by or on your behalf or by third parties as a result of your breach of this Agreement or your use of this site.

10. Attorney's Fees. If Arkansas Farm Bureau Insurance takes any action to enforce the terms and conditions of this Agreement, Arkansas Farm Bureau Insurance will be entitled to recover from You, and You agree to pay, all reasonable attorneys' fees and any cost of litigation, in addition to any other relief, at law or in equity, to which Arkansas Farm Bureau Insurance may be entitled.

11. Termination. Arkansas Farm Bureau Insurance may terminate this Agreement and/or discontinue providing access to this site at any time for any reason, including but not limited to the reasons of improper use of this site or your failure to comply with these terms and conditions. Such termination shall not affect any right to relief which Arkansas Farm Bureau Insurance may be entitled, at law or in equity.
